Website Terms of Use

Effective date: October 28, 2026 · Version: website-terms-v2-r3

These Terms apply prospectively when you validly accept this version. Earlier signups are not treated as acceptance of revised Terms.

Clear terms for the free Discomfrt website and email waitlist.

Who these terms cover

ComfrtZone LLC, based in Virginia, United States, operates Discomfrt and discomfrt.com. These Website Terms govern our promotional website, product demonstrations and email waitlist. They do not govern an app account, a community membership, AI assistance or a purchase. Those services require their own applicable terms and notices before they become available.

You can browse without joining the waitlist. You accept the Website Terms identified at signup when you deliberately check the Terms box and submit. Browsing alone, a previous signup or silence does not record acceptance of a revised agreement. Our Website Privacy Policy explains information handling; it is not permission for unrestricted use of your information.

Eligibility and your email

The waitlist is intended for people ages 13 and older in the United States. Do not submit information about a child under 13. Use an email address you control, and do not enroll another person without permission.

If you are below the age of legal adulthood where you live, have a parent or legal guardian review these Terms with you and obtain any permission required by applicable law. A checkbox does not override laws governing a minor’s ability to agree. This website does not verify age or grant eligibility for a future app, beta or community.

What joining the waitlist means

Joining is free. It does not create an app account, reserve a guaranteed place, start a trial or subscription, authorize a charge, or promise early access, compatibility, availability or a launch date. We may change launch plans, limit testing places, or close the waitlist, subject to our existing obligations.

Your separate email-permission choice covers Discomfrt early-access invitations, launch news and occasional product updates. You can withdraw that permission at any time through the unsubscribe method in an update email or by contacting support@discomfrt.com. Withdrawal does not authorize unrelated marketing and does not require accepting new terms.

Product previews and example content

The screens and interactions on this website demonstrate a product in development. Some are proposed designs rather than captures of a released app. Features, appearance, pricing, supported platforms and release timing may change. App Store and Google Play references describe intended availability, not current availability, approval or endorsement.

Profile photos may be AI-generated, and names, stories and situations may be created for the demonstration. These examples are not claims that the depicted people are members, have used Discomfrt, or achieved a result. They are not customer reviews or testimonials.

Personal choices and safety

Discomfrt is presented as a personal-growth product in development. Website suggestions, previews and example conversations are general information, not medical care, therapy, diagnosis, treatment, professional advice or an emergency service. They do not create a clinical, fiduciary or other professional relationship.

No improvement in confidence, wellbeing, relationships or another outcome is guaranteed. Consider your circumstances, health, accessibility, finances and surroundings before trying an activity. You can adapt, decline, pause or stop. Do not follow an idea that is unsafe, unlawful or unsuitable, or delay professional care because of website content.

This website does not organize or supervise meetings, verify people or venues, or monitor visitors for emergencies. Support correspondence is not an emergency channel. Contact appropriate local emergency services if there is immediate danger. These statements do not excuse our own unlawful conduct or remove rights that cannot lawfully be waived.

Respectful and lawful use

Do not use the site to submit spam or malicious code, impersonate others, harass people, infringe rights, collect personal information without authority, bypass access controls or attempt unauthorized access. Do not disrupt the site, abuse the form, or use automation to overwhelm our services.

We may restrict abusive traffic, reject fraudulent or unauthorized submissions, or suspend access reasonably needed to protect the service, comply with law or address a breach of these Terms. We do not restrict lawful privacy requests or honest criticism.

Ownership and information you send

The Discomfrt name, logo, website design and protected original materials belong to ComfrtZone LLC or their respective owners, to the extent protected by law. You may browse and use the site for its intended purposes. No ownership, trademark rights or broader license is transferred to you.

You retain rights in original material you send us. We may handle a waitlist submission or support message only as reasonably needed for the purposes described in Privacy and applicable law. This does not grant permission to publish private correspondence, use it as a testimonial, or train AI on it. Please do not send passwords, identity documents, private journal entries or confidential material that is unnecessary for your request.

Third-party services and availability

Tally collects waitlist responses. Our hosting, security and business-email providers help operate the website and correspondence. External links can take you to services with their own terms and privacy practices. We do not control independent third-party services, but remain responsible for our own legal obligations and provider decisions.

We may maintain, modify or discontinue the website or a preview. Access may be interrupted, and example content can contain errors. To the extent permitted by law, the free website is provided “as is” and “as available,” without a promise of uninterrupted access, complete accuracy, suitability for a particular purpose or absence of every technical error. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement. No informal email, example, promotional statement or conversation creates an additional contractual warranty unless an authorized company representative expressly agrees to it in writing. This does not override an enforceable written commitment, a legally binding representation, a mandatory warranty, or responsibility for misleading conduct.

Risks outside our control

Independent people and places. We do not investigate, endorse, insure or guarantee the conduct, identity, competence, reliability or safety of independent people, venues, events, businesses or external services depicted or linked on this website. A photo, name, example story or link is not a background check, identity verification, recommendation to meet, or assurance of safety. This website does not match visitors, arrange meetings or supervise real-world activity.

Your independent actions. If you choose to try an activity or contact someone outside this website, assess the conditions yourself. Check permission, access, costs, opening times and suitability; protect your whereabouts and personal information; and decline or stop when an activity feels unsafe or unsuitable. Do not trespass, violate another person’s boundaries, disregard professional advice or attempt an activity beyond your abilities because of an example shown here.

Examples, automated content and changing information. Product demonstrations, sample conversations and AI-generated imagery can be fictional, inaccurate, incomplete or out of date. They are not personalized instructions or verified statements about an actual person or place. An example does not promise that a feature will launch, that a suggestion will be appropriate, or that any result will follow. This website does not provide a live AI adviser.

Networks, devices and disruption. Access can be affected by your equipment, connection, software, security settings or independent provider outages. We do not guarantee that every message will arrive, every resource will load or every technical threat will be prevented. We do not accept private journals or other content for safekeeping through this waitlist; do not treat a preview, form or support mailbox as a backup.

Allocation of responsibility. To the extent permitted by law, the Discomfrt Parties defined below are not liable for loss caused solely by an independent third party’s conduct, your unlawful or unsafe independent action, or an event outside our reasonable control. This does not excuse our contribution to a loss, our own breach of an enforceable duty, or liability that the law does not allow us to exclude. We do not undertake supervision, professional care, identity verification, continuous monitoring or emergency intervention through this website except to the extent an obligation is imposed by law.

Events outside reasonable control

To the extent permitted by law, we are not responsible for delay or failure to perform a website obligation directly caused by an event beyond our reasonable control, such as a natural disaster, war, civil emergency, government restriction, widespread utility or telecommunications failure, or an independent provider outage that we could not reasonably prevent or overcome. An event is not outside our control merely because performance becomes inconvenient or expensive.

This provision does not excuse reasonable safeguards, required security or incident response, an obligation that applicable law makes nonwaivable, or any payment or refund already owed. We remain responsible for steps reasonably within our control to address the disruption.

Important limits on liability

Scope and protected parties. This section applies only to this free website and waitlist. “Discomfrt Parties” means ComfrtZone LLC and its directors, officers, employees and authorized agents acting within the scope of their work for the company. Those parties are intended beneficiaries of this section and may rely on it to the extent legally permitted; their inclusion does not create separate or additional monetary caps. They do not automatically govern a future app, subscription or purchase.

Excluded categories of loss. To the fullest extent permitted by applicable law, the Discomfrt Parties are not liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from this website or waitlist, including lost profits, revenue, business opportunities, goodwill or loss of use. This applies whether a claim is framed in contract, tort or another theory, even if the possibility of such loss was described in advance, but only where that exclusion is lawful.

Combined monetary limit. For claims that can lawfully be limited, the total aggregate liability to you of all Discomfrt Parties together arising from this website and waitlist is limited to the greater of US$100 or the amount you paid ComfrtZone LLC specifically for the website service giving rise to the claim during the preceding 12 months. Joining the waitlist currently costs nothing. This is one combined limit across your claims and the Discomfrt Parties, not a separate limit for each event, claimant’s legal theory or company representative, except where applicable law requires a different result.

Rights these limits do not remove. None of these exclusions, the monetary cap or any other provision releases or limits liability for fraud, intentional misconduct or gross negligence, or for death or personal injury to the extent a limitation is prohibited by applicable law. Nothing here is an advance release of negligence liability for personal injury where that release is prohibited, including under Virginia law. No statutory remedy, privacy or data-protection duty or other liability is waived where the law does not permit the waiver. They do not waive a claim against someone personally where the law prohibits that waiver. Where a category of damage or remedy is legally protected in your circumstances, that protection takes priority. A prohibited limitation does not apply to you.

No additional penalty for bringing a concern. We do not impose mandatory arbitration, a class-action waiver, a waiver of regulator complaints or a shortened statutory deadline. A good-faith complaint, honest review, lawful privacy request or ordinary use of the website does not create a duty to pay our legal fees.

Responsibility for deliberate unlawful misuse

To the extent permitted by applicable law, a user legally capable of undertaking this obligation agrees to reimburse the Discomfrt Parties for reasonable damages and legal costs awarded to a third party in a final judgment, or included in a settlement the user approves, but only to the extent directly caused by that user’s intentional unlawful misuse of the website. Examples include knowingly supplying another person’s information without authority, deliberate infringement, impersonation or an unauthorized attack on the service.

This is not a general duty to defend every claim or to reimburse us for our own negligence, misconduct, unlawful processing or other breach of duty. It does not cover ordinary mistakes, normal participation, an unsuccessful personal-growth attempt, an honest review or the exercise of legal rights. We will give reasonably prompt notice of a covered claim and a reasonable opportunity to participate in its defense. We will not agree to a settlement imposing liability, an admission or a nonmonetary obligation on the user without that user’s written consent. We do not assume this clause binds a minor, parent or guardian where applicable law does not permit it.

Agreement boundaries and enforceability

These Website Terms and any specific written website agreement we expressly make with you define the contractual conditions of this website and waitlist. The Privacy Policy explains processing and your recorded email choice governs the communications you requested. None of those documents creates a general license to use private information, an app subscription, a guarantee of access or a clinical relationship.

An amendment or waiver must be made by an authorized company representative and cannot override applicable law or a required new acceptance. A failure or delay in exercising a right is not a waiver. If a provision cannot lawfully be enforced, it is severed or narrowed only to the extent the law permits, and the remaining provisions continue where lawful. No severability or governing-law wording turns a prohibited waiver into an enforceable one.

Questions, disputes and changes

Contact support@discomfrt.com about the website, your signup, these Terms or a concern. You are welcome to contact us first, but doing so is not a condition of exercising a legal right or meeting a filing deadline. Virginia law governs to the extent consistent with mandatory protections applicable to you. These Terms do not force you to bring a claim in a particular county or remove access to a competent court or regulator.

When we materially revise these Terms, we will identify the new version and effective date and provide notice or request fresh agreement when required. Revised terms are not silently applied to earlier accepted versions, past events or existing subscribers who have not validly accepted them. We preserve prior published versions. If a provision cannot be enforced, the remaining provisions continue to the extent lawful. The failure to enforce a provision on one occasion does not waive a right on another.
